Bench Trials vs. Jury Trials A trial is a court hearing before either a judge or jury, where the judge or jury will examine and review the facts and the law applicable to the case. A bench trial is a trial before a judge. In essence, during a bench trial, facts and evidence are presented to the judge (the trier of fact), the judge hears the evidence, and then determines the defendant’s guilt or innocence. For misdemeanor crimes, if the matter proceeds to trial, the trial will be held before a judge only, without a jury. If a defendant is charged with either a gross misdemeanor or a felony, then the law requires the defendant to be afforded a trial before a jury. In a jury trial, the jury is the trier of fact, and the jury makes the determination of the defendant’s guilt or innocence.
