Probable Cause to Arrest

What is Probable Cause?

In a Las Vegas Domestic Violence case, the arresting agency (usually a police officer) must have probable cause in order to arrest someone.  Probable cause is generally defined as: (1) a reasonable belief that a person has (2) committed a crime, or at least (1) a reasonable amount of suspicion, supported by (2) circumstances sufficiently strong to justify a prudent and cautious person’s belief that (3) certain facts are true.

If a person is arrested, the police officer will transport him or her to jail.  At the jail facility, facility staff will take photos of and obtain fingerprints from the individual (sometimes referred to as the “booking” process). 

In some instances a case will begin when an individual receives a summons from the court.  If a domestic violence case begins with a summons, the person accused of a crime may be required to report to the jail facility, and then submit to the procedures as outlined above (photos, fingerprints).  This process is commonly referred to as a “walkthrough.”  The person accused of a crime will normally be granted an own recognizance release after the above procedures are completed.  The “walkthrough” process can take several hours to complete.

As a general rule, family members, friends, and attorneys have the ability to obtain information concerning an arrest by contacting the jail directly.  In order to get information, these individuals need the name, date of birth and social security number to provide to the information officer at the jail.  This information will minimize the chance of receiving incorrect information regarding a case.
